ORDERS

Unless otherwise agreed, the purchase order will be considered valid to all intents and purposes only when the Customer will return the duly signed ORDER CONFIRMATION issued by us. Any request for order cancellation must be received within 48 hours of receipt of the order confirmation and in any case must be authorized by the sales office. The delivery terms indicated on our order confirmation will in any case start from the date on which we receive the order confirmation signed for acceptance.

According to the art. 10 of Law 196/2003, the buyer is informed that his personal data are entered into the OnAutomation S.r.l. database, as this is necessary for the correct performance of the contractual relationship and for the fulfillment of some legal provisions, as well as for statistical, commercial, marketing, promotional, credit protection/management/transfer purposes.

The personal data of the purchasing party are processed through automated and paper-based tools by authorized parties, with the use of security measures designed to guarantee confidentiality. The personal data of the purchasing party can be communicated to public bodies, debt collection companies or companies, consortia, or associations with commercial, market research or marketing purposes.

The data controller is OnAutomation S.r.l., to which the buyer can apply to exercise the rights referred to in article 13 of the aforementioned law.

To this end, the buyer is informed that at any time he can have access to his personal data, by requesting their update, correction or cancellation and / or he can object to their processing.

PRICES

The present price list cancels and replaces all previous editions.

The prices indicated in the price lists are not binding, OnAutomation S.r.l. reserves the right to make any changes it deems necessary without prior notice. The prices to be applied are in any case those of the official price list in force at the time of delivery, even if the goods are delivered later than the expected date. Prices are expressed in Euro (VAT excluded).

RETURN OF GOODS

The goods are returned ex works, OnAutomation S.r.l. Molina di Malo (VI) plant - Italy, unless otherwise agreed in writing. Any shipping costs, insurance and other charges related to the forwarding of the goods are charged to the customer.

Transport and shipping with any means are always considered to be made at the risk of the Customer even when the delivery has been agreed ex works. In any case, no responsibility can be attributed to OnAutomation S.r.l. in the event of breakage, damage, theft or tampering even in the event that the client himself collects the goods with his own vehicle or with a carrier of his choice.

The buyer side undertakes to verify the quantitative conformity and the integrity of the packages sent in contradiction with the carrier or the forwarder.

TERMS OF DELIVERY

The expected or agreed delivery terms are always purely indicative, reflecting normal production conditions susceptible to alteration during the preparation of the goods.

If the payment of a security deposit is required, the terms remain suspended until the deposit has been received by OnAutomation S.r.l.

Delays in deliveries, whatever the cause, do not give the right to claim for damages.

PAYMENTS

Unless otherwise agreed in the order confirmation, payment must be made in full and directly to our headquarter.

In the event of non-collection of the goods or cancellation of the order when the goods are being prepared, the security deposit paid by the buyer will remain acquired by OnAutomation S.r.l.

Payment must be made within the agreed term. Failure to pay invoices, even partial, beyond the established deadline will determine the starting date of the interest for the payment delay pursuant to Legislative Decree No. 231 of 9 October 2002, in addition to debiting any bank charges and commissions.

WARRANTY

The guarantee on the products guaranteed to the final consumer must be understood as a conventional guarantee according to article 133 of the Legislative Decree 6 September 2005, n. 206 (Consumer Code).

Valid 24 (twenty-four) months from the date of purchase. OnAutomation S.r.l. guarantees the repair or free replacement of the non-compliant good. It is up to the consumer, through a delivery document issued by the seller or by another document (tax receipt, cash receipt, etc.), which shows the name of the seller and the date on which the sale was made, to prove that this warranty must still be considered valid.

The warranty does not include: faults or damages caused by transport, caused by chemical agents and / or atmospheric phenomena, negligence or carelessness in use (eg failure to observe the instructions for the operation of the appliance), installation or maintenance performed by personnel unauthorized, due to circumstances that, in any case, cannot be traced back to manufacturing and / or conformity defects of the goods.

OnAutomation S.r.l. declines all responsibility for any damage that may, directly or indirectly, result to people, things or pets as a result of failure to comply with all the instructions indicated in the specific instruction manual.

Repairs or replacements are carried out exclusively by OnAutomation S.r.l. The transport costs of the return are to be borne by the buyer, while the reshipment of repaired or replaced parts is the responsibility of OnAutomation S.r.l.

COMPLAINTS

Any claims for quantitative differences or for damaged packages must be notified in writing and by registered letter within 8 days of the discovery of the anomaly, and within 30 days, where there are operating defects that can be discovered with the use of the product.

After 8 days from the arrival of goods to the recipient, the are considered fully accepted.

RETURN ACCEPTANCE

Product returns are not permitted unless previously agreed and defined with OnAutomation S.r.l. In the case of authorized returns, the products must be returned ex works and with a packaging free of charge. In any case, return requests will not be taken into consideration for items not on the price list in force at the time of the request.

The credit referred to returns not due to causes attributable to OnAutomation Srl will suffer a 30% depreciation.

PRODUCT CHANGES

OnAutomation S.r.l. reserves the right to make improvements or modifications to its products at any time according to its own criteria and without prior notice. Descriptions, illustrations and technical data contained in catalogs, brochures, etc. are not binding.

DISPUTES

The purchase contracts concluded in accordance with the General Conditions of Sale are subject to and must be interpreted according to the Italian legal provisions, with the exclusion of any other right. For any dispute, the court of Padua is exclusively competent.
